Subject: Information re-bandit prisoners transferred to the National Penitentiary, Managua, Nic.

Reference: (a) Telegram Area Commander, Western Area, No. 17428 April 30.

Enclosures: (1) Statement of Francisco Hernandez.
(2) Statement of Maximo Cruz

1. In accordance with reference (a) the two bandit prisoners Francisco Hernandez and Maximo Cruz were transferred to the National Penitentiary on May 21, 1930.

2. The two prisoners mentioned were captured near San Francisco, Department of Chinandega, on April 16, 1930 by a Guardia Nacional patrol under the command of Lieut. W. Christy, G.N., who states that the prisoner Maximo Cruz was acting as sentry for a group of thirty bandits under Ferbonio Vaquedano. Said Maximo Cruz was found asleep outside of the house of Francisco Hernandez with a red and black hat band on his hat, he was captured together with Hernandez who is thought to be helping the bandits if not actually one of them and Vaquedano?s group was caught asleep just a few yards from Hernandez?s house, fire was opened on them and four bandits killed. When Maximo Cruz was first captured I interviewed him at Somotillo and he readily admitted having been a member of Vaquedano?s group, and admitted having been with this group near Villaneuva just a few days previously when they had stolen horses and other articles, he did not say anything about having been forced to go with the bandits, but upon his arrival at Chinandega he claimed that he had only been with them a short time and was forced to go with them. Francisco Hernandez claimed that the bandits had frequently passed by his house and that he had given them food but disclaimed any connection with the group other than having helped them to obtain food.

3. Upon arrival of these two prisoners at Chinandega a native spy was placed in the same cell with them and they told this man that they had expected to be joined by the group of bandits under Ortez near Villanueva and attack that town but that Ortez had not shown up. They now disclaim any knowledge of such a statement.

DECLARACION DE: HERNANDEZ, Francisco. ?Capturado como bandolero Siembro de las fuerzas de Fervonio Vaquedano.?

Yo, Francisco Hernandez, 39 anos de edad, casado, con domicilio en Santa Teresa, jurisdiccion de San Francisco, y agricultor de oficio, declare que fui capturado por la Guardia Nacional un Miercoloes, cuya fecha no recuerdo, por el delito de que pasaron por mi casa los bandoleros encabezados por Fervonio Vaquedano.

Declaro que el mencionado dia Fervonio Vaquedano llego a mi finquita y despues de haberme quitado como tres arrobas de maiz se fue junto con su gente; y no me di cuenta de que los bandoleros se habian quedado cerca de mi finca sino que hasta que llego la Guardia Nacional, quienes me capturaron y trajeron a esta ciudad.

Que es todo lo que se relacionadcon lo sucedido y juro que lo anterior dihho es la verdad, solamente la verdad, y nada mas que la verdad.

Dada en Chinandega el 20 de Mayo de 1930, y se excusa de firmar por no saber.

DECLARACION DE: CRUZ, Maximo. ?Capturado como bandolero de las fuerzas de Fervonio Vaquedano.?

Yo, Maximo Cruz, de 23 anos de edad, soltero y con domicilio de San Marcos de Colon, Honduras, y agricultor de oficio, declaro que: el miercoles cuya fecha no recuerdo fui capturado en un punto denominado Santa Teresa, finca de San Francisco Hernandez, por la Guardia Nacional, habiendome encontrado con los bandoleros de Fervonio Vaquedano, que me habian capturado cuatro dias antes ye me habian llevado con ellos en contra mi propia voluntad.

Que durante el tiempo que anduve con las fuerzas de Vaquedano se que robaron en varias fincas ocho bestias y una albarda, tambien supe por boca de los demas individuos que andaban que los hermanos Jose Angel, Emilio y Rafael Sandoval proporcionaron a las fuerzas de Vaquedano tres rifles ?infumes?.

Se y declare de mi expontanea voluntad por haberlo visto que Vaquedano traia una fuerza de treinta hombres armados con rifles, pistolas y escopetas, y cinco hombres mas entre los cuales venia [?] yo, sin rifles y desarmados, porque aparte de no tener las armas aun nos denian desconfianza.

Que es todo lo que se ha relacionado en este asunto, y no puedo dar ningun dato acerca de las ideas o movimientos pensados por Fervonio por no haber tenido confianza con ellos. Que lo anterior dicho es la verdad, solamente la vendad y nada mas que la verdad.

Dada en Chinandega, a los 20 dias de Mayo de 1930, y se excusa firmar por no saber.
